That seems more plausible to me than a copyright issue. Very few classical recordings require such an overdub, so it's something a mastering engineer could have missed.
The nightingale sound is in the score, and it's not something inessential that can simply be omited, because it's almost like a solo in that passage. Every recording of Pines of Rome I have heard (about a dozen) has it.
BTW, concerning bird copyrights, the booklet of the 2010 Neschling release on BIS says "The recording of the nightingale singing in "I pini di Giancolo" is used with kind permission of Reinhold Meissner."

The BIS performance doesn't even come close to this one, in my opinion, though it was recorded with better sound. I would love to hear if they did a remastering job that is significantly better than the original, which suffered from the multiple micing and restricted dynamic range.
